ADA & FMLA

The reality is that 41% of working age adults (20-65) have at least one chronic condition.  Another fact is that an individual is more likely to make use of disability insurance than life insurance.  Unfortunately, many patients do not take advantage of these two important Federal Laws and allow their chronic condition to progress to the point that it becomes a disability which threatens their livelihood.  You can always talk to your human resource department to learn more about these programs and how it relates to your particular company.
I) The Federal Americans with Disabilities Act (ADA)

- requires employers with > 15 employees to make a ‘reasonable accommodation’ for a disabled worker as long as it does not present an ‘undue hardship’ to the company and the employee can perform the job’s essential functions.

II) Family and Medical Leave Act (FMLA)

- requires companies with > 50 employees to provide eligible employees up to 12 weeks of unpaid leave during any 12-month period to deal with the birth (adoption) of a child, their own illness, or the illness of a family member without fear of losing their job.
